The following key documents provide basic information for construction suppliers seeking opportunities to do business with the Department of Commerce in the construction related works.

The Code specifies the principles and standards of behaviour to be observed by any contractor, subcontractor, consultant and supplier wishing to do business with government.

The Department of Commerce is implementing the 2008-2010 Contractor Prequalification and Best Practice Accreditation Scheme for construction related works for contracts valued at:

·         greater than $0.5M (prequalified contractors); or

·         greater than $2.5M (Best Practice accredited contractors).

This new integrated Scheme replaces the previous Contractor Prequalification Scheme 2005-2007 and Contractor Best Practice Accreditation Scheme 2005-2007 (refer to the document for replacement scheduling).

The Scheme prequalifies contractors for a range of Building works, contract systems, contract values and locations. The Scheme aims to promote initiatives and business practices by construction contractors that lead to a more competitive, innovative, productive and safe industry that is also socially and environmentally responsible.

The Department of Commerce has implemented Consultant Prequalification Scheme for consultants.  The Scheme aims to prequalify consultants for specified work categories and engagement values.

 

This new Scheme replaces the previous Consultant Prequalification Scheme 2004-2007.

The Department of Commerce has developed procedures to measure and report on the performance of contractors and consultants. Key objectives and underlying principles of performance measurement are outlined.

The Building and Construction Industry Security of Payment Act 1999 (NSW) creates fair and balanced payment standards for construction contracts.  This law provides for the use of progress payments, quick adjudication of disputes over progress payments and security over any disputed payments until resolution is achieved.
